Applicable plan

Applicable plan means the single lowest cost bronze plan available in the individual market through the Exchange serving the rating area in which the individual resides (without regard to whether the individual purchased a qualified health plan through the Exchange) that would cover all individuals in the individual's nonexempt family. For purposes of this paragraph (e)(4), an individual'snonexempt familymeans the family (as defined in 1.5000A1(d)(4)) that includes the individual, excluding any family members who are otherwise exempt undersection 1.5000A3 or are treated as eligible for coverage under an eligible employer-sponsored plan underparagraph (e)(3)(i)of this section. The premium for the applicable plan takes into account rating factors (for example, an individual's age or tobacco use) that an Exchange would use to determine the cost of coverage.
