Castro was a former inmate with the Hawaii Department of Public Safety. While incarcerated at the O`ahu Community Correctional Center (OCCC), she was forced to the ground by two corrections officers while she was seven months pregnant. Castro was then transferred to the Women's Community Correctional Center (WCCC), where she soon began experiencing complications with her pregnancy.
Sexual battery is defined and classified as a Class 1 misdemeanor under the Code of Virginia. A person commits this offense if they sexually abuse another individual by force or intimidation, without consent, if they engage in sexual abuse against one person more than once, or against multiple people within a two-year period, or if they commit sexual abuse while holding a position of authority over the victim. Sexual abuse includes acts of molestation, arousal, or gratification through intentional touching of a victim’s intimate parts or of material covering those parts.
The 2019 amendment expanded the eligibility for free health services provided under the 2015 Act. It extended benefits to women who had worked in or were resident in institutions connected to the Magdalen Restorative Justice Ex-Gratia Scheme, including adjoining institutions recognized in the 2018 Addendum to that scheme.
The Redress for Women Resident in Certain Institutions Act 2015 established a statutory scheme providing free health services to women who had lived and worked in designated institutions, such as the Magdalen laundries, Mother and Baby Homes, and other related facilities designated for vulnerable women. Many of the women placed in these institutions were subjected to abuse and forced labor.
Female inmates in Washington State correctional facilities alleged sexual abuse by the male prison guards. As a remedial remedy, the Department of Corrections designated 110 positions as female-only. These female-only positions included observing female prisoners in sensitive locations, such as showers, as well as performing pat downs. The Teamsters Union representing the correctional officers sued the Department for violations of Title VII of the Civil Rights Act for gender discrimination in employment.
