Jean Paul Akayesu, mayor of the Taba commune, was responsible for maintaining law and order during the 1994 genocide in Rwanda. The Court found that he had knowledge of the killing of thousands of Tutsis in Taba but failed to prevent these acts despite his legal duty. In certain instances, he directly participated in the violence. The Court also determined that Akayesu knew of sexual assaults committed by armed local militia against civilians who sought refuge at the communal office but did nothing to stop them. He was convicted of genocide and crimes against humanity. On appeal, the Appeals Chamber rejected Akayesu’s arguments and upheld the trial judgment. This case is historically significant as it was the first to recognize that sexual violence can constitute both a crime against humanity and an instrument of genocide. The tribunal’s definitions of rape and sexual violence were groundbreaking in international law.

 

Jean Paul Akayesu, bourgmestre de la commune de Taba, était chargé du maintien de l’ordre public pendant le génocide de 1994 au Rwanda. Le tribunal a constaté qu’il avait connaissance des massacres de milliers de Tutsis à Taba mais n’avait rien fait pour les empêcher, alors même qu’il en avait le devoir. Dans certains cas, il a participé activement à ces violences. Le tribunal a également établi qu’Akayesu savait que des milices locales armées commettaient des violences sexuelles contre des civils réfugiés au bureau communal, sans qu’il tente de les prévenir. Il a été déclaré coupable de génocide et de crimes contre l’humanité. En appel, la Chambre d’appel a rejeté ses arguments et confirmé le jugement de première instance. Cette affaire est historique car elle a reconnu pour la première fois que la violence sexuelle pouvait constituer à la fois un crime contre l’humanité et un instrument de génocide. Les définitions de viol et de violence sexuelle adoptées par le tribunal ont marqué une avancée majeure en droit international.
