11 AAC 90.025 - Authority to enter and ownership information
(a) Each
application must include the following for the land within the permit area:
(1) the name, address, and, if known, the
telephone number of
(A) each legal or
equitable owner of record of the surface and mineral estates;
(B) each holder of record of any leasehold
interest; and
(C) each purchaser of
record under a real estate contract; and
(2) the name and address of every owner of
record of the surface and mineral estates that are contiguous to any part of
the proposed permit area.
(b) Each application must include a
description of the legal authority for the applicant's right to enter the
permit area to begin operations and must state whether the right is the subject
of pending litigation. The description of the legal authority must identify
relevant documents by type, date of execution, and the specific land to which
they pertain.
(c) If the private
mineral estate to be surface mined has been severed from the private surface
estate, the applicant shall also provide at least one of the proofs required by
AS
27.21.180(c)(6).
