15 AAC 112.770 - Confidential records
(a) The board will, in its discretion, act to
preserve the confidentiality of information that discloses the particulars of
the business or the affairs of a private enterprise, investor, borrower,
advisor, consultant counsel or manager if the board concludes that such
disclosure
(1) would likely have an adverse
effect on the ability of the board to perform its duties;
(2) would reveal trade secrets or technical
data reasonably held as confidential in the finance industry; or
(3) would violate provisions of
law.
(b) In taking
actions under this section to preserve confidentiality, the board will, in its
discretion, declare specific records of the board, including documents
submitted to the board that were prepared by others, to be confidential and
exempt from the public disclosure provisions of
AS
40.25.110 and
AS
40.25.120 by
(1) express determination of the
board;
(2) guidelines of the
board;
(3) confidentiality
provisions included in contracts; or
(4) confidentiality provisions in requests
for proposals or invitations to bid.
