18 AAC 64.250 - Definitions

In this chapter

(1) "department" means the Department of Environmental Conservation;

(2) "fast-food restaurant" means a restaurant that sells food packaged in disposable containers or wrappers, even when the food is to be consumed on the premises;

(3) "litter receptacle" means a container used to hold litter;

(4) "person" means a governmental agency in addition to the entities listed in AS 01.10.060(7);

(5) "public place" means an area open to and used by the public, whether owned or operated by public or private interests;

(6) "recreation area" means an area officially designated for public recreation use by the agency with management jurisdiction over the area; and

(7) "tavern" means a business establishment operating under a beverage dispensary license in accordance with AS 04.11.090, except that an establishment which derives a preponderance of its income from the sale of food is not a tavern.
