WHEREAS, other laws of this State require certain State officers and employees to furnish bond but without the amount thereof being fixed by statute; and

WHEREAS, Paragraph (B) of Section 12 of Act 338, approved March 24,1955, provides that,

"The Board shall prescribe the amount of the bond of each such officer or employee who is required by law to give bond for the faithful performance of his duties and for the proper accounting of all funds received and disbursed by him as such officer or employee, in each instance where the amount of such bond is not provided by law; and in determining the amount of bond, the Board shall take Into consideration the degree of responsibility of the office or employment, and the probable amount of funds which will be handled during the period of time to be covered by said bonds; and, in the instance of cash funds, it shall be sufficient to fix the amount of bond in terms of a percentage of the probable amount of funds to be handled."

NOW THEREFORE

THE STATE BOARD OF FINANCE DOES HEREBY RESOLVE:

SECTION 1. That pursuant to the provisions of Paragraph (B) of Section 12 of Act 338, approved March 24, 1955, the official bonds of the following named officers and/or employees be fixed in the respective amounts indicated:

SECTION 3.
(A) That pursuant to the provisions of Sections 13-306(D) and 13-412(C), Arkansas Statutes, 1947, the following are hereby designated disbursing officers of appropriations made available for the agencies or purposes indicated, and that such officers not be required to make bond in addition to that hereinbefore provided:

University of Arkansas Disbursing Officer Students, Out-of-State Dental Schools (Act 422 of 1963)

(B) That the Treasurer of the Prairie Grove Battlefield Commission be and he is hereby designated disbursing officer of funds appropriated by Act 341 of 1963, and of all cash funds available to the Commission, and that such Treasurer furnish bond to the State, with a corporate surety thereon, in the penal sum of $10,000, conditioned upon the faithful performance of his duties and the proper accounting of all funds received and disbursed by him.
SECTION 4.
(A) That the officers and/or employees of all departments, agencies, boards and institutions operating in whole or in part by the use of "cash funds" (those funds not deposited in the State Treasury),who are required by law to furnish bond without the amount thereof being specified, shall furnish bond of an amount (to the nearest $1,000) based on the cash receipts of the respective said departments, agencies, boards and institutions for the twelve-month period next preceding the year to be covered by said bonds, as follows:

First $50,000 of receipts

10%

Next $50,000 of receipts

5%

Receipts exceeding $100,000

1%

Provided, that the penalty of none of such bonds shall be less than $1,000.

(B) In the event the head of any department, agency, board or institution shall be of the opinion that the amount of the penalty of any such bond (based on the foregoing formula) is larger than that which should be furnished by him because of an expected decline in receipts during the period to be covered by the bond, or for other logical reason, he shall file a written request with the Secretary of this Board for a reduction in the amount of said bond; and the said Secretary, acting for and in behalf of this Board, be and he is hereby authorized to consider each such request and to take such action by way of reducing the amount of the penalty as, in his opinion, is warranted by the facts so presented. Provided j, that the amount of the penalty on any such bond may not be reduced by the Secretary without the approval of at least three members of the Board, and each such action shall be laid before the Board at its first meeting following the action, and each such action shall be subject to approval, rejection or modification by this Board.
SECTION 5. That the Secretary of this Board be and he is hereby authorized to designate a person to act as disbursing agent, and fix the amount of his disbursing agent's bond, in instances where appropriations are made available to a state agency or to a non-governmental agency or activity, and no disbursing agent is provided for by law. Provided that in each such instance the said Secretary shall obtain the advice and approval of not less than two members of the Board. Provided further, that each action by the Secretary with respect to the foregoing authorization shall be laid before the Board at its first meeting following the action, and each such action shall be subject to approval, rejection or modification by this Board.
SECTION 6. The heads of all offices, departments, agencies, boards and institutions shall determine the amounts of the fidelity bonds, if any, to be furnished by their respective employees, and all such bonds shall be filed in the offices of the respective said departments, agencies, boards, and institutions.
SECTION 7. That the Secretary of this Board be authorized and directed to file certified copies of this resolution with the Auditor of State, Treasurer of State, Secretary of State and State Comptroller.
