RESIDENTIAL DAYCARE EXCEPTION

[M] 609.2 Where required. A Type 1 hood shall be installed at or above all commercial cooking appliances and domestic cooking appliances used for commercial purposes that produce grease vapors. A residential hood is allowed for protection of domestic cooking appliances in child care facilities.

Exception: Residential hoods are not required in day care facilities licensed for sixteen (16) or less, when operated in the care giver's primary residence and the cooking performed during the hours of day care operation does not produce grease vapors.

609.2.1 Where required - retroactive in existing buildings or structures. A residential hood shall be installed in all child care facilities by January 1, 2017.
904.2.1 Commercial hood and duct systems. Each commercial kitchen exhaust hood and duct system required by Section 609 to have a Type I hood or residential hood shall be protected with an approved automatic fire-extinguishing system installed in accordance with this code.

Exception: Automatic fire extinguishing systems are not required in day care facilities licensed for sixteen (16) or less, when operated in the care giver's primary residence and the cooking performed during the hours of day care operation does not produce grease vapors.
