Cal. Code Regs. Tit. 17, § 58524 - Transportation Service Contracts
(a) A contract for transportation service
between a regional center and a vendor shall be in writing, except as provided
in subsection (b) below, and shall not exceed five years including all
amendments.
(b) The following shall
not require written contracts:
(1) Temporary
transportation service purchased pursuant to Section
58541; or
(2) Transportation service purchased using
standardized rates pursuant to Section
58542.
(c) All written contracts shall include:
(1) The provisions specified in Title 17,
California Code of Regulations, Sections
50607 through
50611;
(2) A provision that the schedules and routes
for regional center consumers shall be subject to the approval of the regional
center;
(3) The amount of the
vendor's liability insurance coverage;
(4) A stipulation that the vendor shall not
subcontract any part of the service to be provided without prior written
approval of the vendoring regional center;
(5) A stipulation that both parties shall be
excused from performance during the time and to the extent that either party is
prevented from performing by acts of God, strikes, commandeering of vehicles,
materials, products, plants or facilities by the government when evidence
thereof is presented to the other party;
(6) A stipulation that the vendor shall not
deny services or employment to any person on the basis of religion, color,
ethnic group identification, sex, sexual preference, age, physical or mental
disability;
(7) A stipulation that
the contract is subject to any additional restrictions, or conditions enacted
by the Legislature and contained in the Budget Act or any other statute enacted
by the Legislature which may affect the provisions, terms or funding of this
contract in any manner; and
(8) A
stipulation that the contract may be amended as specified in Section
58525.
