Cal. Code Regs. Tit. 22, § 54431 - Service Area
(a)
Each adult day health center shall serve only participants living in the
service area specified in the county plan and approved by the Department. An
exception to this requirement may be granted only if the center meets a special
need of a particular individual residing outside the service area. Special
needs shall be limited to:
(1) The individual
does not reside in an adult day health service area.
(2) The adult day health care center in the
individual's service area does not provide a needed service.
(3) The individual is a former resident of
the service area.
(4) The center
offers strong ties to the cultural background of the individual which are not
available in the area in which the individual resides.
(b) The following procedures shall be
followed in obtaining a waiver:
(1) The center
shall send a written waiver request to the Department. A personal letter from
the individual stating the reasons for the request shall be attached.
(2) The center shall request a written
statement from the participant's personal physician explaining why the lack of
service area waiver would be detrimental to the person's total health
needs.
(c) The Department
shall not provide reimbursement for transportation provided outside the service
area.
