Cal. Code Regs. Tit. 3, § 10707 - Appeals-Submission
(a)
The registered certifying agent or certified operation may appeal a notice of
denial, proposed suspension or revocation, suspension or revocation, or the
imposition of administrative fines pursuant to section
10701(e), by
submitting a written request for an informal hearing to the Department of Food
and Agriculture, Legal Office of Hearings and Appeals, 1220 "N" Street, Suite
315, Sacramento, California 95814 or via email to [email protected]. The
request shall be received by the department within 30 calendar days after the
date of the notice. The request shall include the following:
(1) Certifying agent or certified operation's
(respondent's) name, mailing address, and daytime phone number;
(2) Respondent's certification number (if
applicable);
(3) A copy of the
notice; and
(4) A request for a
telephonic hearing, if preferred.
(b) If the respondent fails to submit a
request for hearing pursuant to subdivision (a) of this section, the proposed
suspension or revocation may not be appealed and the department may proceed
without a hearing.
