Cal. Code Regs. Tit. 9, § 7128 - General Requirements
(a) An Individualized Plan for Employment
(IPE) shall be developed and implemented consistent with the requirements of
this Article. Services shall be provided in accordance with the provisions of
the IPE.
(b) Once an individual has
been determined eligible to receive services from the Department and is in a
priority category being served under an Order of Selection implemented pursuant
to Section 7053 of these regulations, the IPE
must be developed in collaboration with the eligible individual as soon as
possible, but no later than 90 days from the date of the eligibility
determination. The following exceptions apply:
(1) If exceptional and unforeseen
circumstances beyond the control of the Department arise, and the individual
and the Department agree to a specific extension of time for IPE development, a
rationale and date for the extension, signed by the individual and the
qualified vocational rehabilitation counselor must be entered into the record
of services for that individual.
(2) Only one extension may be agreed to by
the qualified vocational rehabilitation counselor and, in such case, the IPE
must be developed by the agreed upon date, unless an additional extension is
approved by the appropriate District Administrator.
(c) The Department must conduct an assessment
for determining vocational rehabilitation needs, if appropriate, prior to
development of the IPE, for each eligible individual who is in a priority
category being served under Order of Selection. This assessment is conducted
consistent with Section
7001.5 of these regulations to
determine the employment outcome and the nature and scope of vocational
rehabilitation services to be included in the IPE.
(d) The IPE must be designed to achieve a
specific employment outcome in competitive integrated employment, as defined in
Sections 7006.3 and
7011 of these regulations, that is
selected by the individual and is consistent with the individual's unique
strengths, resources, priorities, concerns, abilities, capabilities, career
interests, and informed choice.
