12 CCR 2510-1-10.420.82 - Local LTC Ombudsman Legal Representation [Rev. eff. 12/1/10]
A. Adequate legal counsel shall be available
to the CLTCO and able, without conflict of interest, to:
1. Provide advice and consultation needed to
protect the health, safety, welfare, and rights of residents; and,
2. Assist the CLTCO and its representatives,
including Local LTC Ombudsman entities, in the performance of official
duties.
B. Adequate
legal counsel shall be available to any representative of the CLTCO for legal
representation of a LTC ombudsman against whom legal action is brought in
connection with the performance of long-term care ombudsman duties and
functions as described in Sections
26-11.5-101 through
26-11.5-108, C.R.S., the Colorado
Long-Term Care Ombudsman.
