3 CCR 708-1-80.8 - Sexual Harassment
(A)
Sexual harassment which results in discrimination in employment, housing,
public accommodations or advertising is a violation of the Law. Sexual
harassment includes unwelcome sexual advances, requests for sexual favors, and
other verbal or physical conduct of a sexual nature. Sexual harassment is a
violation of the Law when either, submission to such conduct is made explicitly
or implicitly a requirement of employment, housing, public accommodations or
advertising, or an individual's response to such conduct is the basis for
decisions which deny the individual rights protected by the Law.
(B) Sexual harassment shall be determined
from the totality of the circumstances, which may include, but are not limited
to, the nature of the sexual advances and the context in which the alleged
incidents occurred.
