3 CCR 713-1.27 - UNPROFESSIONAL CONDUCT RELATING TO THE PRESCRIBING OF STIMULANT DRUGS
A.
Basis: The
general authority for promulgation of rules and regulations by the Colorado
Medical Board ("Board") is set forth in sections
12-20-204(1),
12-240-106(1)(a),
C.R.S., whereby, the Board may adopt such rules and regulations as the Board
may deem necessary or proper to carry out the provisions and purposes of this
Article.
B.
Purpose: The following rules and regulations have been
adopted by the Board to further define unprofessional conduct, specifically the
generally accepted standards of medical practice regarding prescribing of
stimulant drugs, more generally set forth in section
12-240-121(1)(j),

C. Prescribing of stimulant
drugs (amphetamine or sympathomimetic amine drugs designated as Schedule II
controlled substances) shall be in accordance with generally accepted standards
of medical practice including, but not limited to, the treatment of severe or
treatment-resistant depression. Prescribing of stimulant drugs is not
acceptable for purposes of diet control for weight loss, increasing work
capacity to combat the normal fatigue associated with any endeavor, or to
chemically induce euphoria.
