8 CCR 1206-1 Sec2 I Part 7.0 - New Technologies
7.1. To
best aid the improvement of containment technology:
(a) The Colorado Department of Agriculture
may allow the use of containment processes or techniques that satisfy the
requirements of these rules although an engineer need not sign or seal them,
provided the operator proves to the satisfaction of the Department that the
process or technique has a reasonably substantial chance for success prior to
implementation.
(b) The process or
technique may continue to be used for a maximum of two years with an annual
review by the Department. After two years the process or technique must be
signed and sealed by an engineer or discontinued.
(c) If the technique or procedure fails or if
during or at the conclusion of the two years the experimental process or
technique is deemed unacceptable by the Department, it shall be discontinued
and the operation must be brought into compliance with these rules within two
years.
