Fla. Admin. Code Ann. R. 29D-6.001 - Purpose
(1) In recognition of the Northeast Florida
Regional Planning Council's (NEFRPC) role in facilitating intergovernmental
problem solving, a voluntary regional dispute resolution process (RDRP) is
hereby established to reconcile differences on planning, growth management,
disputes arising from the intergovernmental review required by local government
intergovernmental coordination element, or inconsistencies between port master
plans and local government comprehensive plan, and other issues among local
governments, regional agencies and private interests. Components of the RDRP
consists of: process initiation; situation assessment; settlement meetings,
mediation or advisory decision making; and settlement agreements.
(2) Use of this process shall not alter a
jurisdiction's, organization's, group's or individual's right to judicial or
administrative determination of any issue if that entity is entitled to such a
determination under statutory or common law.
(3) Participation in the RDRP as a named
party or in any other way does not convey or limit intervenor status or
standing in any judicial or administrative proceedings.
