Fla. Admin. Code Ann. R. 5J-18.0128 - Resolution of Violations, Settlement, and Additional Enforcement Remedies
(1) Failure to respond to an administrative
complaint shall result in the entry of a default Final Order. The department
shall impose administrative fines in a default Final Order up to the maximum
amount allowable under Section
616.242(21),
F.S.
(2) A failure to comply with
either a Final Order or a default Final Order of the department shall result in
revocation of the amusement ride permit and an administrative fine against the
owner or manager of the amusement ride of $2,500 per violation, per day.
Additional penalties shall be sought through the enforcement of the order in
circuit court.
