Fla. Admin. Code Ann. R. 64B20-7.002 - Probable Cause Determination
(1) The
determination as to whether probable cause exists to believe that a violation
of the provisions of Part I of Chapter 468, or Chapter 456, F.S., or of the
rules promulgated thereunder has occurred shall be made by a majority vote of
the Probable Cause Panel.
(2) The
Probable Cause Panel shall be composed of at least two members. One member of
said panel may be a former Board member. One member of the panel shall be a
current or former consumer member if one is available, is willing to serve, and
is authorized to do so by the Board Chair. At least one member of the panel
shall be a current Board member.
(3) The probable cause members shall be
assigned by the Chair, and shall meet as necessary, or at such times as called
by the Chair or by the Agency.
