Fla. Admin. Code Ann. R. 69O-150.102 - Applicability
(1) These rules shall apply to any Life
Insurance Policy and Annuity Contract "advertisement," disseminated in this
State which the insurer knows or reasonably should know is intended for
presentation, distribution or dissemination in this State, when such
presentation, distribution or dissemination is made either directly by an
insurer or indirectly on behalf of an insurer, by an agent, broker, producer or
solicitor or any other person who has either actual or apparent authority to
act on behalf of the insurer; provided the insurer shall not be responsible for
advertisements that are published in violation of written procedures or
guidelines of the insurer. Further, provided, that in variable contracts where
disclosure requirements are established pursuant to Federal regulation, these
rules shall be interpreted so as to minimize or eliminate conflict with such
Federal Regulation wherever possible.
(2) Advertising materials which are
reproduced in quantity shall be identified by form numbers or other identifying
means. Such identification shall be sufficient to distinguish an advertisement
from any other advertising materials, policies, applications or other materials
used by the insurer.
