Ga. Comp. R. & Regs. R. 513-1-1-.07 - Applications for Involuntary Separation Retirement Benefits Due to a Change in Administration Under O.C.G.A. Sec. 47-2-123(g)(4)(C)
(1) In the event
the Board of Trustees is presented an application for involuntary separation
retirement benefits as a result of a change in administration, the Board will
consider the size of the agency and the nature of the administrative change in
its review of the application.
(2)
In the event the effective date of the proposed separation is more than twelve
(12) months but less than eighteen (18) months after the administration has
changed, the Board will require an appearance before the Board of the official
or officials proposing the separation to explain the delay.
(3) The Board will not consider any
application for involuntary separation retirement benefits that occurs as a
result of a change in administration if the administration has been in office
eighteen (18) months or more at the time the separation is proposed.
