Idaho Admin. Code r. 36.01.01.072 - MOTIONS

01. Form and Contents. A motion should: (4-6-23)
a. Fully state the facts upon which it is based; (4-6-23)
b. Refer to the particular provision of statute, rule, order, notice, or other controlling law upon which it is based; and (4-6-23)
c. State the relief sought. (4-6-23)
02. Oral Argument. If the moving party desires oral argument on the motion it must state so in the motion. (4-6-23)
03. Prehearing Motions. Unless otherwise provided in these rules, a prehearing motion must be filed at least fifteen (15) days prior to a scheduled hearing to be considered by the Board. (4-6-23)
04. Answer to Motion. An answer to a motion, or a request for additional time to respond, may be filed within ten (10) days after the filing of the motion. (4-6-23)
