Ill. Admin. Code tit. 35, § 702.109 - Enforcement Actions
Any person may file a civil complaint with the Board alleging violation of the RCRA or UIC regulations, a permit requirement, or permit conditions, pursuant to Title VIII of the Act and 35 Ill. Adm. Code 103.
a) A formal complaint filed with the Board
will initiate a civil enforcement action in which the complainant bears the
burden of proving that the respondent committed the alleged
violations.
b) The Board will
forward any informal complaint to the Agency, and the Agency must investigate
the alleged violations set forth in the complaint.
