Ill. Admin. Code tit. 35, § 704.163 - Emergency Permits
a)
Coverage. Notwithstanding any other provision of this Part or 35 Ill. Adm. Code
702 or 705, the Agency may temporarily permit a specific underground injection
if an imminent and substantial threat to the health of persons will result
unless a temporary emergency permit is granted.
b) Requirements for Issuance
1) Any temporary permit under subsection (a)
must be for no longer term than required to prevent the threat.
2) Notice of any temporary permit under this
subsection (b) must be published in accordance with 35 Ill. Adm. Code
705.163
within 10 days after the issuance of the permit.
3) The temporary permit under this section
may be either oral or written. If oral, it must be followed within five
calendar days by a written temporary emergency permit.
4) The Agency must condition the temporary
permit in any manner it determines is necessary to ensure that the injection
will not result in the movement of fluids into a USDW.
