Kan. Admin. Regs. § 123-12-314 - Sexual intercourse; sodomy
(a) No offender
shall commit or induce any other person to commit an act of sexual intercourse
or sodomy, even with the consent of the other person. Participation in such an
act shall be prohibited.
(b) No
offender shall perform any of the following:
(1) Force or intimidate another person to
engage in sexual intercourse or sodomy;
(2) solicit or arrange for the application of
force or intimidation by another person in order to engage in sexual
intercourse or sodomy with another person; or
(3) participate in any scheme or arrangement
to force or intimidate another person to engage in sexual intercourse or
sodomy.
(c)
(1) "Sexual intercourse" shall mean any
penetration of the female sex organ by a finger, the male sex organ, or any
object. Any penetration, however slight, shall be deemed sufficient to
constitute sexual intercourse.
(2)
"Sodomy" shall be defined as any of the following:
(A) Oral contact with or oral penetration of
the female genitalia or oral contact with the male genitalia;
(B) anal penetration, however slight, of a
male or female by any body part or object; or
(C) oral or anal copulation between a person
and an animal.
(d) Each violation of this regulation shall
be a class I offense.
This regulation shall be effective on and after April 8, 2005.
