Kan. Admin. Regs. § 129-9-18 - Motions

(a) Each motion shall meet the following requirements, unless the motion is made during a hearing:
(1) Be submitted in writing; and
(2) state with specificity the basis of the motion.
(b) Unless otherwise specified by the presiding officer, the opposing party shall have 15 days from the date of mailing, electronic filing, or personal delivery of the motion within which to file a response. The presiding officer may waive or change the deadline for good cause.
(c) Unless otherwise specified by the presiding officer, the party that filed the motion shall have five days from the date of mailing, electronic filing, or personal delivery of the response filed pursuant to subsection (b) within which to file a reply.
(d) The presiding officer on that individual's own motion or at the request of either party may conduct a state fair hearing on the motion. Each party requesting a state fair hearing shall include the request in the motion or response. The presiding officer may render a decision on the motion after receipt of the response, reply, and any state fair hearing on the motion.
