Kan. Admin. Regs. § 30-10-1d - Inadequate care
(a) If the agency
determines that inadequate care is being provided to a recipient or that a
recipient's rights are being violated, payment to the nursing facility may be
terminated or suspended.
(b) If
the agency determines that a nursing facility has not corrected deficiencies
that significantly and adversely affect the health, safety, nutrition, or
sanitation of the nursing facility residents, payments for new admissions shall
be denied and future payments for all recipients shall be withheld until the
agency determines that the deficiencies have been corrected.
(c) This regulation shall be effective on and
after May 1, 2005.
