06- 096 C.M.R. ch. 3, § 7 - Impartiality

Hearings must be conducted in an impartial manner. Upon a timely allegation, made in good faith, of bias or of personal financial interest, direct or indirect, of a Presiding Officer, Commissioner or Board member in the proceedings, requesting that person disqualify him or herself, that person shall determine the matter as part of the record. Should the person alleged to be biased request it, an allegation must be reduced to writing by the person making the allegation with an adequate time for response on the record. The Presiding Officer, Commissioner, or Board member to whom the charge of bias or of personal financial interest is directed may consult with the Office of the Attorney General or private counsel concerning the charge.
