10-144 C.M.R. ch. 24, § 5 - Conditions for Purchasing Services
1. An agreement
to purchase services shall be entered into at the sole discretion of the
Department. However, the Department may elect to purchase services within the
limits of available funding when:
A. the
Department has determined that the need to purchase services exists because:
(1) client services from a provider or
individual will exceed $2,500 per year per provider or individual; or
(2) purchased services will aid the
Department in its operations, or
(3) MaineCare regulations require the
execution of an agreement as an authorization to bill MaineCare for services;
and
B. the services to
be purchased do not duplicate existing services; and
C. the services to be purchased comply with
the intended purposes of the State, Federal, or other funding source, and have
been approved as part of the Department's financial allocation plan.
