Md. Code Regs. 08.19.02.03 - Local Program Filing Requirements

A. The local authority shall include in its application for the Department's approval:
(1) Information required in Regulation .02 of this chapter;
(2) A letter requesting approval, signed by the appropriate official;
(3) Three copies of proposed laws, ordinances, regulations, or amendments to existing laws, ordinances, or regulations, including code provisions and permit requirements, which show that the requirements of Natural Resources Article, 5-1601-----5-1612, Annotated Code of Maryland, and this subtitle have been met;
(4) Three copies of the local technical manual or a statement that the local authority proposes to adopt the Forest Conservation Manual;
(5) Three copies of the proposed policy document; and
(6) The name of the person to be contacted by the Department regarding the application.
B. The Department shall acknowledge receipt of the application in writing by regular mail.
C. The Department shall consider an application complete if:
(1) It contains all of the information required in §A of this regulation; and
(2) The information is sufficient for the Department to process the application.
D. The Department shall notify the local authority in writing not later than July 1, 1992, whether the program is approved.
E. After the Department approves the program, the local authority shall:
(1) Hold hearings, unless hearings have been held before submittal to the Department for approval; and
(2) Adopt the program in accordance with its procedures for enacting a law, ordinance, or regulation, by December 31, 1992, or sooner.
F. If the Department does not approve the proposed local program, the Department shall give notice in writing that:
(1) The application is incomplete, identifying the additional information needed;
(2) The application requires revision; and
(3) There is a specified date by which a revised application shall be submitted to the Department.
G. A revised application shall be submitted to the Department within 2 months of the date the Department notified the local authority of the need for revisions.
H. A local authority shall have in effect by January 1, 1993, an approved program which meets or is more stringent than the requirements and standards of this subtitle.
I. If a local authority has not adopted a program by January 1, 1993, the Department shall assume review and approval of all forest stand delineations and forest conservation plans within the jurisdiction of that local authority.
