Md. Code Regs. 26.13.07.12 - Termination of Permits
A. The
following are causes for terminating a permit during its term, or for denying a
permit renewal application:
(1) Noncompliance
by the permittee with any condition of the permit;
(2) The permittee's failure in the
application or during the permit issuance process to disclose fully all
relevant facts, or the permittee's misrepresentation of any relevant facts at
any time;
(3) A determination that
the permitted activity endangers human health or the environment and can only
be regulated to acceptable levels by permit modification or
termination;
(4) Failure to pay the
permit fee in a timely manner; or
(5) Failure to comply with any applicable
State environmental law or regulation.
B. For purposes of this chapter, the term
"termination" means the same as the term "revocation" in Environment Article,
Title 7, Annotated Code of Maryland, and Regulation .11 of this
chapter.
C. The Secretary shall
follow the requirements of Regulations .20-.20-6 of this chapter in terminating
any permit.
