Md. Code Regs. 26.26.01.05 - Exemptions

A. The following persons and entities are exempt from paying fees:
(1) Government agencies;
(2) Farmers whose principal residence is located on their farm;
(3) Charitable organizations as defined under Business Regulation Article, ยง 6-101(d), Annotated Code of Maryland;
(4) Petroleum retail facilities, including marinas, with storage capacities of less than 75,000 gallons of gasoline and less than 100,000 gallons of diesel or similar fuel;
(5) Any entity that is exempt under the federal Act; and
(6) Any owner/operator of a facility that does not exceed the federal reporting thresholds for any EHS or hazardous chemical but voluntarily submits a Tier Two emergency and hazardous chemical inventory report to the SERC or the LEPC with jurisdiction over that facility, or both.
B. The Secretary may exempt additional entities from payment of reporting fees.
