205 CMR 6.06 - Claims for Payment from Pari-mutuel Pool
(1)
At a designated location, a written, verified claim for payment from a
pari-mutuel pool shall be accepted by the association in any case where the
association has withheld payment or has refused to cash a pari-mutuel wager.
The claim shall be made on such form as approved by the Commission, and the
claimant shall make such claim under penalty of perjury. The original of such
claim shall be forwarded to the Commission within 48 hours. (ARCI c. 9 g.p.

(2) In the case of a
claim made for payment of a mutilated pari-mutuel ticket which does not contain
the total imprinted elements required in
205 CMR
6.03(2), the association
shall make a recommendation to accompany the claim forwarded to the Commission
as to whether or not the mutilated ticket has sufficient elements to be
positively identified as a winning ticket. (ARCI c. 9 g.p. §

(3) In the case of a claim
made for payment on a pari-mutuel wager, the Commission shall adjudicate the
claim and may order payment thereon from the pari-mutuel pool or by the
association, or may deny the claim, or may make such other order as it may deem
proper. (ARCI c. 9 g.p. § F(2))
(4) In the case of a claim made for a lost
pari-mutuel ticket, the association shall accept the claim on a form approved
by the Commission, and the claimant shall make such claim under the penalties
of perjury. The claimant must identify the amount wagered, approximate time of
wager, race, other tickets purchased during the same transaction, association,
exact wagers made on the lost ticket to include all runners, and the window
number. The association shall investigate the claim and using association
official records, provide the Commission a recommendation and copies of all
applicable documents to support such recommendation. The Commission will rule
on the validity of all claims and hold final decisions until the end of the
calendar year following the calendar year in which the loss occurred. The
Commission will issue a final decision and notify the claimant and the
association of the disposition of the claim. Claims for lost tickets must be
filed with the appropriate association within 48 hours of running of the race
associated with the lost ticket.
