240 CMR 8.04 - Licensure of Barber Shops
(1) No person or
entity shall operate a barber shop without a license issued by the
Board.
(2) Every person
contemplating the opening of a barber shop shall file the appropriate
application for a shop license with the Board, pay required fees, and arrange
for the premises to be inspected and approved by the Board. The Board will not
issue a license for any premises if required local permits and certificates
have not been obtained or if the Board's inspection reveals that the premises
are in violation of 240 CMR 3.00: Cosmetology
Salons.
(3) A license for
a barber shop is valid only for the location and owner named in the license or
certificate, and is not transferable. A holder of a barber shop license seeking
to change the location or owner of the shop shall file an application for a new
license with the Board at least 30 days before any change, and shall notify the
Board immediately in case of closure.
(4)
Conduct of
Operations.
(a) Whenever an
inspection of a barber shop is made by an investigator or other agent of the
Board, the owner of the shop or a representative of the shop must sign the
inspection slip.
(b) No barber shop
shall be operated or maintained in any room or place where food is prepared,
sold or offered for sale.
(5) Barber shops may permit licensees of the
Board of Registration of Massage Therapy to provide services within the scope
of their massage license in the same space as the barber shop, only in full
compliance with all provisions of 240 CMR 3.00: Cosmetology Salons
regarding Dual Use of Room for Cosmetology or Barbering and Licensed
Massage Therapy Services.
