Mich. Admin. Code R. 299.4112 - Emergency disposal; conditions for approval
Rule 112.
(1) If a
material poses a threat or substantial nuisance to the public or the
environment, a person may petition the director to approve the emergency
disposal of the material as follows:
(a) At a
location that is not licensed pursuant to the provisions of the act.
(b) At a disposal area that is licensed
pursuant to the provisions of the act, but is not authorized by a county
plan.
(c) In a manner that is not
in accordance with the provisions of the act or these rules.
(2) Approval of emergency disposal
by the director, or his or her designee, if granted, shall be in compliance
with all of the following provisions:
(a) Be
oral or written. If oral, it shall be followed by written approval within 5
days.
(b) Not be more than 90 days
in duration.
(c) Clearly specify
the type and quantity of material and the manner and location of its
disposal.
