Mich. Admin. Code R. 325.5073 - Self-luminous products containing tritium, krypton-85, promethium-147, or radium-226
Rule 73.
(1)
Except for a person who manufactures, processes, or produces self-luminous
products, a person is exempt from these regulations to the extent that he or
she owns, receives, acquires, possesses, uses, or transfers the following:
(a) Tritium, krypton-85, or promethium-147 in
self-luminous products manufactured, processed, imported, or transferred in
accordance with a specific license issued by the NRC pursuant to section 32.22
of 10 CFR Part 32, which license authorizes the transfer of the product to
persons who are exempt from regulatory requirements.
(b) Naturally occurring material in
self-luminous products manufactured, processed, imported, or transferred in
accordance with a specific license issued by the department or an agreement
state pursuant to equivalent conditions as in section 32.22 of 10 CFR Part
32.
(2) The exemptions
in subrule (1) of this rule do not apply to tritium, krypton-85,
promethium-147, or naturally occurring material used in products for frivolous
purposes or in toys or adornments.
