Mich. Admin. Code R. 400.1412 - Resident behavior management; prohibitions
Rule 12.
(1) A
licensee shall not mistreat or permit the mistreatment of a resident by
responsible persons or other occupants of the home. Mistreatment includes any
intentional action or omission which exposes a resident to a serious risk of
physical or emotional harm.
(2) A
licensee, responsible person, or any person living in the home shall not use
any of the following methods of handling a resident for discipline purposes:
(a) Any form of severe punishment or physical
force.
(b) Restricting a resident's
movement by binding or tying.
(c)
Confining a resident in an area such as a closet, locked room, box, or similar
cubicle.
(d) Withholding necessary
food, rest, or toilet use.
(e)
Mental or emotional cruelty, including subjecting a resident to verbal abuse,
making derogatory remarks about the resident or members of his or her family or
making malicious threats.
(f)
Refusing the resident entrance to the home.
