Mich. Admin. Code R. 400.1934 - Heating; ventilation; lighting; radon
Rule 34.
(1) Each
room that is used by children in care must have adequate ventilation and be
maintained at a safe and comfortable temperature so children do not become
overheated, chilled, or cold. Both of the following apply:
(a) The temperature must be not less than 65
degrees Fahrenheit at a point 2 feet above the floor.
(b) Measures must be taken to cool the
children when the temperature exceeds 82 degrees Fahrenheit.
(2) Windows and doors that are
used for ventilation must be screened and in good repair.
(3) A carbon monoxide detector, bearing a
safety certification mark of a recognized testing laboratory, such as UL
(Underwriters Laboratories) or ETL (Electrotechnical Laboratory), must be
placed on all levels approved for child care.
(4) A licensee shall test the child care home
for the concentration of radon gas before the initial license is issued and
every 4 years thereafter at the time of license renewal.
(5) The lowest level of the child care home
must not have levels of radon gases that exceed 4 picocuries per liter of air,
except as provided in subrule (6) of this rule. Documentation of the results
must be kept on file in the child care home.
(6) If the levels of radon gases exceed 4
picocuries per liter of air in the lowest level of the child care home, the
licensee shall notify the parents of children in care and have a radon
mitigation system installed. The licensee has up to 12 months from the date of
the first measurement to meet the standard in subrule (5) of this
rule.
(7) All child-use areas must
have adequate natural or artificial lighting.
