Mich. Admin. Code R. 400.1963 - Rule variance
Rule 63.
(1) Upon
written request of an applicant or licensee, the department may grant a
variance from an administrative rule if the alternative proposed provides clear
and convincing evidence that the health, welfare, and safety of children is
protected.
(2) The decision of the
department must be entered upon the records of the department and a signed copy
must be sent to the applicant or licensee. A variance may remain in effect for
as long as the licensee continues to comply with the conditions of the
variance, or it may be time-limited.
