Mich. Admin. Code R. 400.4105 - Rule variance
Rule 105.
(1) Upon
written request of an applicant or licensee, the department may grant a
variance from an administrative rule if there is clear and convincing evidence
that the alternative to the rule complies with the intent of the administrative
rule from which a variance is sought.
(2) The department shall enter its decision,
including the qualification under which the variance is granted, in the records
of the department and send a signed copy to the applicant or licensee. This
variance may remain in effect for as long as the licensee continues to comply
with the intent of the rule or may be time limited.
