13 Miss. Code. R. § 3-8.2 - Initiation Of Hearing Procedure; Notice Of Hearing
(a)
Proceedings to review a decision made by the Executive Director pursuant to
Miss. Code Ann. §
75-76-159
must be initiated by the filing and service of a petition in accordance with
Miss. Code Ann. §
75-76-161.
(b) A copy of the petition must be served on
the respondent.
(c) The respondent
may file and serve a written response within 15 days after being served with a
copy of the petition.
(d) After the
time for respondent to file and serve a written response to the petition has
expired, the hearing examiner shall determine the date, time and place of the
hearing on the petition.
(e) Notice
of the hearing must be served by the hearing examiner on each of the parties at
least 20 days before the hearing, unless the hearing examiner reasonably
determines that a lesser notice period is appropriate. (Adopted: 09/25/1991;
