Mont. Admin. R. 17.50.1103 - PROCEDURES FOR EXCLUDING THE RECEIPT OF HAZARDOUS WASTE
(1) The owner or operator of a Class II
landfill unit shall implement a program at the facility for detecting and
preventing the disposal of regulated hazardous waste, as defined in 40 CFR Part
261 and polychlorinated biphenyls (PCB) waste, as defined in 40 CFR Part 761.
This program must include, at a minimum:
(a)
random inspections of incoming loads, unless the owner or operator
takes other precautions to ensure that incoming loads do not contain regulated hazardous waste or PCB waste;
(b) maintaining records of any
inspections;
(c) training of
facility personnel to recognize regulated hazardous waste
and PCB waste; and
(d) notification of the department if a
regulated hazardous waste or PCB waste is discovered at the facility.
