163 Neb. Admin. Code, ch. 2, § 003 - COMMERCIAL FISHING REGULATIONS
The following regulations are prescribed by the Game and Parks Commission, State of Nebraska in accordance with Neb. Rev. Stat. §§ 37-301, 37-304, 37-314, 37-315, 37-322, 37-4,104, 37-543, and 37545. For purposes of these regulations, unless context otherwise requires, the definitions found in Chapter 37, sections 212 through 234 of the Game Law, are used. These regulations are effective following enactment by the Commission, approval by the Attorney General and Governor, and when five days have elapsed since filing with the Secretary of State.
Provided, that it shall be illegal to use seines, hoop nets, trammel nets, wing, dip or trap nets, or any similar device in that portion of the Missouri River above or upstream from the U.S. Hwy. 81 bridge at Yankton, South Dakota to the boat ramp at Santee such described area to include the Lewis and Clark Lake (Gavins Point Reservoir).
Provided, also, that it shall be unlawful to use any seines, trammel nets, wing, dip or trap nets or any similar device, except that not more than six (6) hoop nets per licensed commercial permittee may be used in that portion of the Missouri River upstream from the boat ramp at Santee to the Nebraska-South Dakota state line.
Each commercial permittee shall conform to the creel limits, size limits, methods, mesh sizes, and all other laws and regulations on commercial fishing of the state in which they are fishing and operating such commercial gear.
It shall be unlawful to use hoop nets on the South Dakota side of that portion of the Missouri River upstream from the boat camp at Santee to the Nebraska-South Dakota state line.
The above agreements apply only to the main channel of the Missouri River. All cutoffs formed by straightening or changing the main channel of the river are not a part of the Missouri River; even though one or both ends are open, commercial gear cannot be used in such waters.
