Nev. Admin. Code § 281A.263 - Motion to disqualify member of Commission for good cause
1. The Executive Director or the subject may
submit a motion to disqualify a member of the Commission from participating in
a hearing for good cause.
2. Except
as otherwise provided in this subsection, a motion to disqualify a member of
the Commission must comply with the procedures concerning motions before the
Commission which are set forth in NAC 281A.361 or 281A.442, as applicable. A
motion to disqualify a member of the Commission which is submitted pursuant to
subsection 1 must be ruled upon by the Commission as a whole.
3. In considering a motion to disqualify a
member of the Commission, the Commission will consider any grounds that would
justify the disqualification of a judge pursuant to Rule 2.11 of the Revised
Nevada Code of Judicial Conduct.
4.
If the Commission approves a motion to disqualify a member of the Commission,
the necessary quorum to act upon and the number of votes necessary to act upon
a matter before the Commission is reduced as though the member who is
disqualified was not a member of the Commission.
