Nev. Admin. Code § 286.400 - Claims that benefits are community property

1. The Executive Officer shall acknowledge receipt of and honor a written claim made pursuant to NRS 123.240 that a member's contributions or benefits are community property.
2. The Executive Officer shall advise the member and claimant that the payment of contributions or benefits will be postponed until 90 days after the normal date of payment so that the claimant may obtain a court order regarding disposition at that time.
3. Any court order must be issued by a court that has jurisdiction over the System and must name the System specifically.
4. The Executive Officer may not make payment of a member's contributions or benefits to any such claimant or pursuant to any court order unless the member applies for a refund or a retirement benefit, or dies.
