Nev. Admin. Code § 288.368 - Rehearings: Order for modification
1. Any order
modifying a decision or order of the Board issued pursuant to NAC
288.364 incorporates those
portions of the prior order or decision which have not been changed or modified
by the subsequent order.
2. Except
as otherwise provided in this subsection, for purposes of judicial review, a
modifying order is to be considered the final order of the Board. The modifying
order of a panel is to be considered the final order of the Board for purposes
of judicial review if the modifying order:
(a)
Is unanimous; or
(b) Is a split
decision and:
(1) No timely petition for
reconsideration by the full Board is filed in accordance with sections 6, 7 and
8 of this regulation; or
(2) A
timely petition for reconsideration is filed but denied by the full
Board.
