Nev. Admin. Code § 439B.510 - Reasonable cause to believe that prohibited transaction between hospital and related entity has occurred
Reasonable cause to believe that a violation of subsection 2 of NRS 439B.430 has occurred includes, but is not limited to:
1. The failure of a
hospital or related entity to submit the copies required by NAC 439B.490
concerning an agreement, contract or transaction between the hospital and a
related entity.
2. One or more
related agreements, contracts or transactions between the hospital and its
related entities resulting in:
(a) An increase
in the hospital's operating expenses;
(b) A decrease in the hospital's net patient
revenue; or
(c) A combination of
paragraphs (a) and (b), of more than 1 percent from the previous fiscal
year.
3. The value of
the goods, services or consideration which is the subject of an agreement,
contract or transaction between the hospital and a related entity being found
to be materially different from the fair market value for similar agreements,
contracts or transactions between nonrelated entities in the same
area.
