N.H. Admin. Code § Tra 502.04 - Highway Project Design Criteria
(a) Highway
projects constructed with state highway aid shall be designed in accordance
with the following design standards and manuals:
(1) AASHTO Standard Specifications for
Structural Supports for Highway Signs, Luminaires, and Traffic Signals, 6th
Edition (2013) and interim revisions;
(2) AASHTO Policy on Geometric Design of
Highways and Streets (2011, 6th Edition);
(3) Federal Highway Administration Manual on
Uniform Traffic Control Devices, as adopted by the commissioner as a policy for
traffic control standards (2009 and subsequent revisions);
(4) AASHTO Roadside Design Guide, 4th Edition
(2011);
(5) New Hampshire
Department of Transportation (NHDOT) Standard Specifications for Road and
Bridge Construction, 2010 Edition; and
(6) New Hampshire Department of
Transportation (NHDOT) Highway Design Manual (1999).
(b) Upon written application of a
municipality, the department shall waive any of the minimum design standards
relating to municipal highways affected by the project:
(1) Unless it determines that the requested
waiver, if granted, would result in an imminent or substantial threat to human
health, public safety, or the environment; and
(2) If the municipality has accepted, in
writing, responsibility for construction that does not meet the waived minimum
design standards.
