N.J. Admin. Code § 10A:16-11.3 - Notification of inmate of involuntary medication hearing
(a) An inmate under
consideration by the Treatment Review Committee for receiving involuntary
medication shall be given written notification at least 24 hours before the
hearing. Verbal notice shall be provided to illiterate inmates, inmates not
sufficiently conversant with the English language and inmates otherwise unable
to read due to a physical/medical inability.
(b) The notice shall include the following:
1. The inmate's mental health
diagnosis;
2. The medication(s)
prescribed to treat the inmate's illness;
3. The recommendation to administer the
prescribed medication to the inmate against the will of the inmate;
4. The reason(s) for the
recommendation;
5. The date, time
and location of the hearing;
6. The
staff advisor appointed by the chairperson of the Treatment Review Committee,
assigned to assist the inmate; and
7. Notation of verbal notice to the inmate
requiring same.
