N.J. Admin. Code § 11:24C-3.8 - Effect of Bulletin OMC 2001-04
(a) Carriers
that have agreements for the provision of services and supplies for home
treatment of bleeding episodes associated with hemophilia with one or more
persons identified in Bulletin OMC 2001-04 as acceptable health care providers
of such services may continue to refer covered persons to such health care
providers, and the carrier shall be considered in compliance with these rules
until whichever of the following occurs first:
1. The Department makes a determination and
provides written notice to the person that the person does not meet the
standards for designation, if the person files an application for designation
in accordance with
11:24C-2.4;
2. The person loses designation pursuant to
11:24C-2.1 0; or
3. The carrier and person otherwise terminate
their agreement, or amend one or more terms thereof, with respect to the
provision of services for home treatment of bleeding episodes associated with
hemophilia.
(b) In the
event that a person identified in Bulletin OMC 2001-04 as an acceptable health
care provider of services and supplies for the home treatment of bleeding
episodes associated with hemophilia elects not to file an application for
designation, or files an application but does not receive designation, the
carrier shall comply with the requirements of
11:24C-3.4, as if the person had
lost designation.
